Official rules

NO PURCHASE NECESSARY. PARTICIPATION IN THIS CONTEST IS FREE. PURCHASE OF THE SPONSOR'S PRODUCTS OR SERVICES WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. SPONSOR: The Savannah College of Art and Design, Inc., 342 Bull Street, Savannah, Georgia 31401 (the "Sponsor").

2. ELIGIBILITY: The SCAD® Sidewalk Arts Festival Online Competition (the "Contest") is open to: (a) currently enrolled students of Sponsor who are at least 16 years of age at time of entry ("SCAD Student Entrants"), (b) alumni of Sponsor ("SCAD Alumni Entrants") and (c) legal residents of the 50 U.S. states and the District of Columbia who are at least 14 years of age and are currently enrolled high school students at time of entry ("High School Entrants"). SCAD Student Entrants, SCAD Alumni Entrants and High School Entrants are collectively referred to herein as the "Entrants". All Entrants under 18 years of age (or other jurisdictional age of consent) must have permission to enter from legal guardian.

3. HOW TO ENTER: The Contest begins at noon EDT on Tuesday, April 13, 2021 and ends at 5 p.m. EDT on Tuesday, April 27, 2021 (the "Contest Period"), according to the Sponsor's time clock. To enter, entrants must create an original artwork compliant with the "Guidelines and Restrictions" set forth below and comply with the following "Entry Requirements" applicable to their category.

SCAD Student Entrants must visit scad.edu/sidewalkarts and submit the following "Entry" electronically via the form made available on the site: (a) legal name, mailing address, phone number and SCAD email address; (b) SCAD ID number; (c) SCAD campus location; (d) Class status and major; (e) preferred email address; (f) social media handles (optional); (g) one unedited digital photo of the original artwork (photo and artwork must comply with the Guidelines and Restrictions); (h) acknowledgement agreeing to these Official Rules (including, but not limited to granting SCAD rights to use the submitted artwork and uploaded photo thereof as detailed below) and representing SCAD Student Entrant has abided by the Guidelines and Restrictions and the Official Rules.

SCAD Alumni Entrants must visit scad.edu/sidewalkarts and submit the following "Entry" electronically via the form made available on the site: (a) legal name, mailing address, phone number, and email address; (b) year of graduation and major; (c) preferred email address; (d) legal name while attending SCAD (optional); (e) social media handles (optional); (f) one unedited digital photo of the original artwork (photo and artwork must comply with the Guidelines and Restrictions); (g) acknowledgement agreeing to these Official Rules (including, but not limited to granting SCAD rights to use the submitted artwork and uploaded photo thereof as detailed below) and representing that the SCAD Alumni Entrant has abided by the Guidelines and Restrictions and the Official Rules.

High School Entrants must obtain a participant code from SCAD (which may be obtained by emailing [email protected] and expressly requesting such code), then visit scad.edu/sidewalkarts and submit the following "Entry" electronically using the participant code via the form made available on the site: (a) legal name, mailing address, phone number, and preferred email address; (b) your preference for staying up to date with the latest SCAD events, opportunities, and exclusive content; (c) desired or actual SCAD enrollment information (i.e., campus, major, start date); (d) current high school and grade; (e) one unedited digital photo of the original artwork (photo and artwork must comply with the Guidelines and Restrictions); (f) acknowledgement agreeing to these Official Rules (including, but not limited to granting SCAD rights to use the submitted artwork and uploaded photo thereof as detailed below) and representing that the High School Entrant has abided by the Guidelines and Content Restrictions and the Official Rules.

For all Entrants, the photograph or digital file of your original artwork must comply with the following technical requirements: (1) image file size must not exceed 8 MB, (2) image must be saved in .jpg format, and (3) the file name format shall be as follows: Artist Name_Artwork Title. Upon uploading, Entrants will receive an auto-response that their Entry has been received. At the conclusion of the Contest, a thumbnail crop of each Entry may be automatically created for Sponsor’s virtual sidewalk experience; clicking or tapping on the thumbnail will reveal the full Entry.

Entrants who comply with the Entry Requirements, the Guidelines and Restrictions (as defined below) and the other terms and conditions of these Official Rules will receive one (1) entry into the Contest within the applicable "Competition Group" of SCAD Student Entrants, SCAD Alumni Entrants, or High School Entrants. Only one (1) Entry per person is allowed. Multiple Entries will be disqualified. Entries that violate Entry Requirements and/or Guidelines and Restrictions or do not meet the submission deadlines will be disqualified. Compliance is determined solely by Sponsor in its sole discretion. Sponsor is not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed, or misdirected Entries, for technical failures of any kind, or any human error which may occur in the receipt or processing of Entries. Standard data charges from your wireless carrier may apply to Entries made via mobile device.

By entering, you (a) fully and unconditionally agree to these Official Rules and the Sponsor's decisions, which are final and binding, and that winning and receiving any Prize (defined below) is contingent upon fulfilling all applicable Entry Requirements; (b) represent and warrant the following with respect to your Entry (including your artwork submitted in connection therewith and the photograph taken thereof): (i) you are the sole and exclusive owner of the Entry and the contents and elements thereof; (ii) the Entry is your own creation and is 100% original; (iii) the Entry does not and will not infringe on any rights of any third parties; and (iv) your Entry complies with the Guidelines and Restrictions; (c) irrevocably grant to the Sponsor a royalty-free, irrevocable, perpetual, non-exclusive right and license to use, reproduce, copy, modify, publish, create derivative works from, distribute, translate, adapt, edit, display, and otherwise exploit your artwork and Entry and your provided social media platforms/handles/pages in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media, or technology now known or later developed, including for promotional or marketing purposes without additional compensation, notification, permission, or approval. If requested, each Entrant will sign any documentation that may be required for the Sponsor or its designees to make use of the non-exclusive rights Entrant is granting to use the Entry and/or referenced social media; and (d) consent to the use of your name and/or likeness (voice, biographical information, city and jurisdiction of residence, statements, screen name(s)/Instagram handle, photograph, and recordings) for advertising and promotional purposes. For the avoidance of doubt, the Contest is in no way sponsored, endorsed, or administered by, or associated with, Instagram. 4. GUIDELINES AND RESTRICTIONS: All Entries are subject to the following Guidelines and Restrictions:

(a) Legal Requirements: For the safety of all participants, artwork and the Entry must be completed exclusively by the Entrant and without in-person assistance from outside parties or collaborators. Entrants must maintain social distancing and comply with government regulations in place in Entrants locality. Disqualification will occur for any violation of social distancing requirements or other applicable law or mandates that occurs in connection with the Entry.

(b) Media Requirements: 2D artistic mediums such as painting, drawing, mixed media, printmaking, digital art, and photography will be considered. Artwork must be visual in nature and two-dimensional flatwork. 3D content will not be judged and will result in disqualification. Additional examples of permissible media include: oil, oil pastel, soft pastel, charcoal, graphite, ink, colored pencil, watercolor, casein, gouache, acrylic, digital art, mixed media (all water media or oil-based media); silver or other metal point, collage; mixed media collage; handmade paper; wax and other crayons on paper or board; printmaking (etching, mezzotint, lithography, woodcut, monotype, mono print, aquatint), photography (digital and analogue). Prohibited media include: short films and videos, moving animations, motion graphics, sound design, costume design, sculpture. (c) Content Requirements: Artwork must be an original work of authorship by the Entrant created solely by the Entrant, and the Entrant must own all right, title and interest in and to the artwork and the Entry. Artwork must not copy, attempt to replicate, resemble or be based on the work of another artist. Artwork that appears to be a reproduction or infringing interpretation of another artist's work will be disqualified. For questions regarding permissible artwork, email a photo of the artwork in question to [email protected]. Artwork submitted must be suitable for public and family viewing. Any artwork that contains nudity, profanity, vulgarity, obscenity, lewdness, hate, disparagement, defamation, slander, libel, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, bigotry, racism, symbols intended as political statements, explicit images, content which violates any law, or other content deemed inappropriate by the Sponsor will be disqualified. Artwork must be original and created specifically for this Contest or, in the case of SCAD Student Entrants and SCAD Alumni Entrants, artwork may also be previous student coursework. Artwork created for any other purpose is not permitted and will be disqualified. Artwork must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement (for example, including brand names or trademarks owned by any person other than the Entrant). Artwork must not contain images, footage, or artwork not created by Entrant.

(d) Other Requirements: Please be careful! Artwork must not contain media which may reasonably cause bodily harm to the Entrant or others. Please work in a well-ventilated room, where required.

5. PRIZES: Subject to the provisions hereof, there will be one Winner selected for each of the categories described in Section 5 (Winner Selection and Notification), for a total of three (3) Winners from each Competition Group, with the following "Prizes" (each, a "Prize") being awarded to such Winners:

SCAD Student Entrant Prizes (payable via check mailed to provided address):

  1. SCAD Student Spirit Award | $1,500
    The SCAD Spirit Award recognizes artwork that amplifies your story, as exemplified by the pillars of SCADamp professional presentation studio: Speak. Visualize. Connect.
  2. SCAD Student Best in Show Award | $1,000
    Artwork otherwise having the highest level of artistic quality and creativity
  3. People's Choice Student Award | $800
    Voice your choice! Judges will select the top four entries to post on the @scaddotedu Instagram, and followers will vote on their favorite. The Entry with the most votes will win.

SCAD Alumni Entrant Prizes (payable via check mailed to provided address):

  1. SCAD Alumni Spirit Award | $1,500
    The SCAD Spirit Award recognizes artwork that amplifies your story, as exemplified by the pillars of SCADamp professional presentation studio: Speak. Visualize. Connect.
  2. SCAD Alumni Best in Show Award | $1,000
    Artwork otherwise having the highest level of artistic quality and creativity
  3. People's Choice Alumni Award | $800
    Voice your choice! Judges will select the top four entries to post on the @scaddotedu Instagram, and followers will vote on their favorite. The Entry with the most votes will win.

High School Entrant Prizes:

  1. First Place Award | $200 Ex Libris* card
    Artwork having highest level of artistic quality and creativity
  2. Second Place Award | $100 Ex Libris* card
    Artwork runner up for highest level of artistic quality and creativity
  3. Third Place Award | $50 Ex Libris* card
    Artwork second runner up for highest level of artistic quality and creativity

*valid for purchases at Ex Libris* campus store (no cash redemption allowed)

6. WINNER SELECTION AND NOTIFICATION: After the conclusion of the Contest Period, all Entries will be segregated by Competition Group (SCAD Student Entrants, SCAD Alumni Entrants, and High School Entrants). There are three (3) awards per Competition Group (as described in Section 5). SCAD Student Entrants and SCAD Alumni Entrants are eligible for (1) SCAD Spirit Award, awarded to the artwork within the Competition Group most exemplifying the “Spirit of SCAD,” the SCADamp pillars: Speak. Visualize. Connect.; (2) Best in Show Award, awarded to the artwork within the Competition Group otherwise identified as having the highest level of artistic quality and creativity; and (3) People's Choice Award, awarded to the artwork within the Competition Group receiving the most votes on Instagram as described below. High School Entrants are eligible for (1) First Place Award, (2) Second Place Award, and (3) Third Place Award, awarded to the artworks within the Competition Group identified as having the highest level of artistic quality and creativity.

The Entries will be judged and awarded as follows: (i) all Entries to be reviewed by a Sponsor-selected team of judges, which team will significantly narrow down the Entries in each Competition Group and select the ones to move forward into the next phase; (ii) a second Sponsor-selected team of judges will review all Entries that passed through the first judging phase and determine (a) for SCAD Student Entrants and SCAD Alumni Entrants, the "SCAD Student Spirit Award", "SCAD Student Best in Show Award", "SCAD Alumni Spirit Award", "SCAD Alumni Best in Show Award" and the remaining top four (4) Entries in each aforementioned Competition Group, and (b) for the High School Entrants, the First Place Award, Second Place Award, and Third Place Award winning Entries; (iii) the second Sponsor-selected team of judges will provide their selections to Sponsor; (iv) at 9 a.m. EDT on April 30, 2021, Sponsor will post the four (4) selected SCAD student Entries to @scaddotedu Instagram Stories, utilizing the 'questions' feature to poll the audience on their favorite SCAD student Entry. Following the uploads of the selected SCAD student Entries, the four (4) selected SCAD alumni Entries will be posted on @scaddotedu Instagram Stories, utilizing the 'questions' feature to poll the audience on their favorite SCAD alumni Entry. After 24 hours, the results of the 'questions' feature will be pulled natively from the backend of Instagram's platform. The SCAD student Entries and SCAD alumni Entries with the highest number of votes through the 'questions' feature will be deemed the "People's Choice Awards" winner in those respective categories.

All winner selections will be determined and identified by Sponsor in Sponsor's sole discretion, provided that "People's Choice Award" are selected by vote as described above. Any ties will be broken via judges and not by chance or odds. Each Entry is eligible for only one Prize. Sponsor shall have the sole discretion to select additional award winners as it determines from among all eligible Entries received during the Contest Period based upon such criteria that it feels appropriate, in its sole discretion. The decisions of the Sponsor, including any identified judges, are final and binding on all matters relating to the Contest.

The potential winners will be notified by Sponsor via the Contest website at scad.edu/sidewalkarts, Facebook and/or Instagram at 3 p.m. EDT on Friday, May 7, 2021, and winners will also be directly notified via the email address included in their Entry (the "Prize Notification"). The potential winners must then follow the prize claim instructions provided in the Prize Notification or the Prize will be forfeited. The potential winners will be required to reply to the Prize Notification via email and provide a mailing address for the prize, telephone number, and/or other information. Except where prohibited, the potential winners (or such potential winner's parent/legal guardian if a minor in his/her state of residence) may be required to sign and return an affidavit of eligibility and liability and publicity release, in form and substance satisfactory to the Sponsor, in order to claim his/her Prize. If a potential winner cannot be contacted, fails to execute and return the affidavit of eligibility and liability and publicity release or provide any other requested information within the required time period (as applicable), or does not comply with these Official Rules, such potential winner will be disqualified and forfeit the applicable Prize. If a potential winner is disqualified for any reason, the applicable Prize may be awarded to an alternate winner selected from among all applicable eligible Entries. Only three (3) alternate winners may (but do not have to) be determined, after which the applicable Prize will remain unawarded. The potential winners who comply with all of the foregoing requirements and ultimately are awarded a prize are known as "Winners." If Winner is unable to accept a Prize or any portion of a Prize for any reason, the Sponsor shall have no further obligation to such Winner. The Winners may be announced by the Sponsor via Facebook (facebook.com/pages/Savannah-College-of-Art-and-Design/106189806079331), Twitter (@SCADdotedu) and/or Instagram (@scaddotedu), and/or any other method of social media, publication and/or public announcement as determined by Sponsor.

7. TAXES AND COSTS RELATED TO THE PRIZES: All applicable taxes, tariffs, and fees are the sole responsibility of the Winners. Winner may be issued a 1099 tax form.

8. GENERAL CONDITIONS: By participating in the Contest and/or by accepting a Prize, participants agree to indemnify, release, and hold harmless the Sponsor and its employees, directors, board members, officers, licensees, licensors, shareholders, members, attorneys, and agents including, without limitation, any person or entity associated with the production, selection/judging, or administration of the Contest (collectively, the "Released Parties"), from any and all claims, demands, damages, losses, liabilities, costs, or expenses caused by, arising out of, in connection with, or related to their participation in the Contest including in connection with their Entry or breach of any representation or warranty contained in the Official Rules. The Contest is designed to increase consumer awareness of and interest in the Sponsor. In the event that the Contest is challenged by any legal or regulatory authority, the Sponsor reserves the right to discontinue or modify the Contest, or to disqualify entrants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any Entrants who are disqualified due to such an action. The Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Contest and/or extend the Contest Period should there be, as solely determined by Sponsor, (a) an insufficient number of eligible and qualified Entries received during the Contest Period as solely determined by Sponsor, (b) any unauthorized intervention or other cause beyond the Sponsor's control, which may corrupt the administration, security, or awarding/judging of the Contest, or (c) any other reason as determined by Sponsor, including in the event of any "force majeure" (defined using the broadest possible definition of the term and expressly including further complications from the COVID-19 pandemic).

9. USE OF PERSONAL INFORMATION: Any information provided to the Sponsor will be used by the Sponsor for the purposes of administering the Contest and for marketing purposes but will not be sold or rented to third parties. The personal information will be collected, processed, and used in accordance with the Sponsor's privacy policy which can be found at scad.edu/content/privacy-and-terms-use. By participating in the Contest, Entrants agree to the Sponsor's collection and usage of their personal information and that they have read and accepted such privacy policy. In addition, personal information of Entrants may be used by the Sponsor to contact Entrants after the Contest is over to provide Entrants with information about the Sponsor and its activities and other promotions.

10. DISPUTES: Each Entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Atlanta, Georgia, USA; (b) any and all claims, judgments, and awards against Sponsor shall be limited to actual out-of-pocket costs incurred by you, including costs associated with entering the Contest, but in no event will you be entitled to attorneys' fees or court costs; and (c) Entrant shall not be entitled to and by entering waives all rights to claim, punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Georgia, USA, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, USA or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Georgia, USA.

11. WINNER'S LIST/OFFICIAL RULES: For a Winner(s) list, please send a self-addressed stamped envelope to Savannah College of Art and Design, SCAD® Sidewalk Arts Festival Online Competition Winners List, 342 Bull Street, Savannah, Georgia, 31401, to be received no later than the date that is 60 days after the end of the Contest Period.
